GIven the concerns raised at the public meeting in July and Aug, it
should have been obvious enough by now for your company to have the
respect to follow up. I see NO information on the website other than a
very generic Q&A that is full of factual errors. No information has come
by mail or in any other media, and the facilitator has not contacted me.
I had sent you an email on Aug. 25, 2010 before the public meeting and
you did not bother to reply.
You were asked at the meeting for planning and operational
documentation. The facilitator of the meeting of Aug 25, 2010
facilitator (which a real facilitator would have been non-partisan and
not for you, the proponent) was to follow up rapidly given the Sept. 7,
2010 cut off date for public input. Nothing has been done to this effect
on your end to help the citizens of this area to inform themselves of
what will have a major economic, and very real environmental and social
impacts long into the future. The residents feel this is the wrong
place for this facility, and that due diligence has not been done to
plan something that will offer adequate assurance of your ability to
make the decision that are truly in the public good. Residents are very
upset with you and feel that your company is bullying their way through
this, what is supposed to be a consultative process, with the goals of
getting the permit and then with the power in hand, you will do the
dictating. It is clear under the Environmental Protection Act, Guide
for Applying for Waste Disposal Sites, that you have failed decisively
level to provide for the proper public notification and consultation -
in english and in french. Our issues and concerns were supposed to,
according to the law, be included BEFORE you submitted the application.
The attached letter is for your immediate review and action. In order
that we receive due public consultation, members of the media have been
contacted to help us spread the word in your failure to mail or post on
your site, any technical or business documentation pertaining to the
proposal. The only piece of information that I found online that your
company would have generated was an english copy of the permit
application. Some folks in vars and with the help of our local
counsellor, did obtain a few other bits of information that are posted
on the vars website.

Futher to my email, and to emphasis the concerns of the citizens who spoke up at today's meeting abut compliance and how can we assure that Carl's will follow its permit limits --- the answer is we cannot. They have already been charged, and found guilty and fined under the Environmental Protection Act. Having done a significant amount of study (bachelors and masters) in environmental sciences, I find it quite significant for a company actually to have a charge stick. Check the text in red re Carl's.
That said, 500$ is not something that has motivational value to avoid the next time.

Ontario haulers plead guilty to violations
Eleven companies and three individuals pleaded guilty to violations under the Environmental Protection Act (EPA).
In May 2005, members of the Ministry of the Environment's Investigation and Enforcement Branch partnered with the Ontario Provincial Police and the Ministry of Transportation in a joint inspection initiative to ensure contaminated soil waste haulers are in compliance with the EPA. The waste haulers were inspected to determine if they are approved to haul contaminated solid non-hazardous waste and if they were operating in accordance with the conditions of a Certificate of Approval.
The court heard that, on May 24, 2005 and May 25, 2005, the defendants were observed to be hauling contaminated solid non-hazardous waste and soil to two landfill sites located in the Ottawa region. Upon inspection, it was revealed that the vehicles transporting the waste were either not authorized to do so or the vehicles were not clearly marked with the name and number of its Certificates of Approval. In other instances the Certificates of Approval were not present in the vehicles as required. Following a two-day inspection, 11 companies and three individuals were charged for violations under the EPA.
Between June 16 and July 14, 2005, the companies and individuals pleaded guilty to the following charges under the EPA:
* Munro & Scullion Contracting Inc., and 1421736 Ontario Limited pleaded guilty to one count of operating or establishing a waste management system without a Certificate of Approval or provisional Certificate of Approval contrary to Section 27(1)(a) and were fined $1,000 each;
* Gestion des Dechets Malex Inc. /Malex Waste Systems Inc., Carl's Sanitation Services Ltd., Mackat Inc., Ray's Haulage Incorporated, 927889 Ontario Inc., all pleaded guilty to one count each for failing to mark the vehicles with the name and number of the Certificates of Approval contrary to Section 10 of Regulation 347 under the EPA. They were fined $500 each; Kimco Steel Sales Ltd. also pleaded guilty to two counts under this section and received a total of $1,000 in fines;
* Peter Alfred Stanley, Jean Claude Levesque and Timothy Stephen Dell pleaded guilty to one count each under Section 10 of Regulation 347. Each individual received a $500 fine.
* 144778 Canada Inc., Services Matrec Inc., and Losey's Haulage Ltd. also pleaded guilty to one count each for violating Certificate of Approval conditions contrary to Section 186(3) of the act. The companies each received a $500 fine. Victim Fine Surcharges are exclusive of the fines.
Justices of the Peace Louisette Girault and William Stewart presided over the matters in the Ontario Court of Justice in Ottawa.

Tonight there was a public meeting at the arena. Residents moslty of Vars were there to express their concerns about the facility.
I would like the Navan Community Association to consider adding the Vars link http://www.waste.rendev.ca/ and in posting a notice about the impacts that the facility is likely to have on the community.
We heard tonight that there would be likely 80 trucks a day rolling down Navan Rd to dump at the Navan landfill. This is not only the problem of Vars and Bearbrook. The residents of Navan will evidently be directly impacted. The plan calls for as many as 300 trucks on Russell Road hauling waste from Ottawa AND they have are apply for the right to haul from Quebec as well. All our communities will suffer from this no doubt.

Hi Everyone,
I had a good talk with our MPP Jean-Marc Lalonde yesterday. He
told me that he is absolutely on our side and will be opposing the
application by Carl's Sanitation.
For those who haven't heard, the comment period deadline has been
extended by 90 days and Jean-Marc will be arrainging a public meeting
with MOE officials and representatives from Carl's to be present,
sometime in August.
Please
spread the word as I don't have all the contact info for everyone who
was at the meeting Wednesday night, or for others who are interested in
this issue.

Dear Resident,
It was brought to my attention
on June 22, 2010 that an application, by Carl’s Sanitation Services
Incorporated, has been submitted for a waste disposal site for a
non-hazardous solid waste processing and transfer facility to be located
at 5001 Hebert Street (just east of Bearbrook Farm).
The application was submitted to
the Ontario Ministry of the Environment.
The Province’s role is
to review the proposal and grant
(or not) the certificate of approval.
Because it’s an Environmental-related proposal, this approval
process falls under the Provincial Environmental Assessment and
Approvals Branch.
The application is now under
review and comments from the public can be made
by July 9th, 2010 at
http://www.ebr.gov.on.ca
and then type in the box: 5001 Herbert.
The City of Ottawa plays no role in the environmental
approval process.
The City does however have a role to play in
regard to the zoning and site plan.
On the issue of zoning:
City staff have advised that the zoning does allow a waste
processing and transfer facility on this site and that the zoning has
been in place since 1982.
This means the applicant is legally allowed to proceed should they
receive Provincial approval.
The applicant has not yet
submitted a site plan which will look at the location of the building on
the lot, as well as road access, parking, drainage, landscaping and so
on. A site plan must be
filed with the City following Provincial approval.
If that occurs I will make sure the City holds a public meeting.
